By ordering products on this website, you agree to these terms of use. Limits On Our Liability If you are buying the products for personal use, then you have the rights and remedies available under the Consumer Guarantees Act 1993 and the following limitation on our liability does not apply. If you are acquiring the products for the purposes of business, then the guarantees and remedies provided under the Consumer Guarantees Act 1993 are excluded and you use the products available from this website at your sole risk. In no circumstances will Fruity Balloons be liable to you for any damages whatsoever arising out of the commercial use of any products from this website. Disclaimer While every effort is made to keep the information on this website current, prices and product availability are subject to change and Fruity Balloons will advise you upon placement of your order if changes have been made during the time since this website was last updated and your order is placed. You can then either agree to still purchase the products or alternatively we will refund any money you have paid. Returns Policy Fruity Balloons will replace defective products, provided that they are defective and not just because you have changed your mind. It is your responsibility to ensure you have made the right choice. Should it be necessary to return goods to Fruity Balloons, we will advise you of the address to return them to. Ordering Feel free to send us an email at info@fruitballoons.co.nz to ask any questions before placing an order. Our online ordering system is simple, and you are not committed to any purchase until you pay for your items at the completion of your order. International Orders We currently only receive orders for delivery within New Zealand. If you are ordering from overseas for delivery to a New Zealand address, please order well in advance, as our payment service takes longer to approve international credit cards before we can dispatch goods. Cancellation By You Prior To Delivery You acknowledge that Fruity Balloons will incur obligations and costs once you place an order with us. Therefore you may not cancel or vary an order once it has been placed with us unless of course Fruity Balloons advise you that delivery cannot be made due to circumstances beyond our reasonable control. Pricing All prices are in New Zealand dollars ($NZD) and include local taxes (GST). When you complete an online purchase you will receive an email quoting the total price for the purchase, and supplying you with our bank account details and instructions so you can arrange payment from your computer, or the ability to pay by an online credit card service. Delivery Balloons in a Box deliveries are made throughout the North Island by Fastway Couriers. Please ensure you select your delivery location at the checkout screen. Check the rural delivery box also if your delivery address is on rural post delivery. We cannot courier goods to PO Boxes, so please use a street address and post code. You will be quoted the freight price for your order at the screen where you enter your address details. This will give you the total price for your order, including freight and GST. Goods are not sent until cleared funds are received by Fruity Balloons. Payment We accept payment by direct banking or by credit card through a third party NZ owned online merchant service. Goods purchased by credit card will be to be sent once funds are cleared by the merchant service. Payments by direct banking will have orders available for dispatch as soon as cleared funds show in our account. When you complete your order you will receive a confirmation email which will give you our bank details for direct banking, with details of your order and the full amount payable. We will only hold goods for 5 business days from the time of order until payment is received (plus any additional time while funds clear). If no payment is received within 5 days of your order, goods in short supply may be released for other sales. Privacy Policy We do not automatically recognise any information regarding your domain or email address when you browse our website. We only collect the email addresses of those who communicate with us by email or purchase goods from us online. The information we collect is for our internal use only and is not shared with other organisations to help them contact consumers for marketing or commercial purposes. Cookies Our online purchasing system sets a cookie on your computer to keep track of goods in your shopping cart only. We do not collect any information from your computer with this cookie. If you have your browser set to not accept cookies, you will not be able to use our shopping cart system. If you still wish to purchase goods from us from a computer that does not accept cookies, make a note of the product codes and email us and we will confirm the total order price and send you information on how to pay for your order. |
